Skadden represented Trinseo PLC, a specialty material solutions provider, and several of its European subsidiaries in a German Arbitration Institute (DIS) arbitration seated in Frankfurt, Germany. The dispute arose from the 2021 divestiture of Trinseo’s synthetic rubber business in Germany to synthetic rubber producer Synthos.
Synthos alleged that Trinseo had not properly disclosed certain information, including the natural gas pricing mechanism for the steam supplied by a third party. The claims amounted to the full enterprise value of the divestiture, approximately $500 million.
On May 7, 2026, the arbitral tribunal ruled in favor of Trinseo by dismissing all of Synthos’ claims. Additionally, Trinseo was awarded its costs for the arbitration.
