New York intellectual property litigation associate Michael Salik discussed the trademark case Sulzer Mixpac before the Supreme Court and a recent decision showing the Trademark Trial and Appeal Board’s increased willingness to cancel trademark registration due to fraud. Palo Alto intellectual property litigation associate Christopher McKinley reviewed Kannuu Pty Ltd. v. Samsung Electronics Co., Ltd, in which the Federal Circuit considers whether a nondisclosure agreement’s forum selection clause extends to Patent Trial and Appeal Board proceedings.
