Paul Kerlin represents corporations and financial institutions, as well as their boards of directors and senior management, in investigations by law enforcement and regulatory agencies, and in related litigation.

Bio

Mr. Kerlin has assisted clients in connection with investigations in the U.S. and internationally involving antitrust and market practices, government contracts, fraud and tort allegations, and purported False Claims Act violations.

He also assists clients in conducting internal investigations and with complex regulatory inquiries, including before the Department of Justice (DOJ), Commodity Futures Trading Commission (CFTC), Securities and Exchange Commission (SEC), state attorneys general, and other domestic and international regulators and competition agencies throughout Europe, Latin America and the Asia Pacific region. In addition, Mr. Kerlin supports clients during congressional inquiries, regarding legislative matters and on public policy issues.

Representations include:

  • assisting a financial institution in responding to parallel investigations by the DOJ, CFTC, Office of the Comptroller of the Currency, Federal Reserve, SEC, U.K. Financial Conduct Authority and more than a dozen other foreign authorities alleging anti-competitive practices in foreign exchange trading;
  • representing a financial institution in antitrust class actions and other litigation alleging foreign currency dealers conspired to manipulate benchmark currency exchange rates;
  • representing a financial institution in a CFTC investigation relating to potential collusion, manipulation and/or group boycotts concerning interest rate swaps;
  • assisting a major company involved in congressional investigations into the Deepwater Horizon/BP oil spill;
  • conducting an internal investigation into improper sales and inventory practices by a computer company's Asian subsidiary;
  • defending a nationwide hospital system in an action brought by the DOJ alleging violations of the False Claims Act;
  • representing a transportation logistics company in a False Claims Act investigation involving allegations that the company submitted false and inflated invoices to a federal agency; and
  • providing regulatory guidance to communications and technology companies.

Mr. Kerlin also handles a variety of pro bono matters, such as juvenile justice, First Amendment and federal criminal issues at all levels, including amicus briefings before the U.S. Supreme Court.
